Terms of Service

1. Agreement to Terms

By accessing or using Samplesize ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Samplesize is an email outreach and research participant management tool designed for UX researchers. The Service allows you to:

  • Manage contacts for research participant recruitment
  • Send personalized outreach emails through your Gmail account
  • Schedule automated follow-up emails
  • Track engagement status (sent, replied, meeting scheduled)
  • Collaborate with team members within an organization

3. User Accounts

3.1 Account Creation

To use Samplesize, you must sign in with a Google account. You are responsible for maintaining the security of your Google account credentials.

3.2 Organizations

Users belong to organizations. Organization owners and admins can invite other users. You are responsible for ensuring that only authorized individuals have access to your organization.

3.3 Account Responsibilities

You are responsible for:

  • All activities that occur under your account
  • Ensuring your contact data is accurate and lawfully obtained
  • Complying with applicable laws and Gmail's terms of service

4. Acceptable Use

4.1 Permitted Uses

Samplesize is designed for:

  • User research and participant recruitment
  • Professional outreach and communication
  • Team collaboration on research projects
  • Managing research participant relationships

4.2 Prohibited Uses

You agree NOT to use the Service for:

  • Spam or bulk unsolicited emails — Sending emails to recipients who have not consented or do not have a reasonable expectation of receiving your communication
  • Harassment or abuse — Sending threatening, abusive, or harassing messages
  • Illegal activities — Any activity that violates applicable laws or regulations
  • Phishing or fraud — Impersonating others or attempting to deceive recipients
  • Malware distribution — Sending links or attachments containing malicious software
  • Violation of Gmail Terms — Any activity that violates Google's Terms of Service
  • Circumventing limits — Attempting to bypass any rate limits or usage restrictions

5. Gmail API Usage

Samplesize uses Gmail's API to send emails on your behalf. By using this feature, you agree to:

  • Comply with Gmail's API Services User Data Policy
  • Use the email sending feature responsibly and ethically
  • Accept that Gmail may impose rate limits on email sending
  • Understand that emails sent through Samplesize appear to come from your Gmail account

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

You retain ownership of the contacts and data you add to Samplesize. We do not claim ownership of your content.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Unscheduled technical issues
  • Third-party service disruptions (e.g., Google API outages)
  • Factors beyond our reasonable control

8. Termination

8.1 By You

You may stop using the Service at any time. You can delete your organization through the profile settings, which will permanently remove all associated data.

8.2 By Us

We reserve the right to suspend or terminate your access to the Service if you violate these Terms or engage in prohibited activities. We will provide notice when possible.

8.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. We may delete your data in accordance with our data retention practices.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Samplesize and are protected by international copyright, trademark, and other intellectual property laws.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAMPLESIZE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Samplesize and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
